| 摘 要： | 1989年救助公约开启了海上救助特别补偿的先河,然而公约第14条所确立的特别补偿制度的不确定性、模糊性,在实践运用中遇到了难以克服的问题.SCOPIC条款的制订,解决了特别补偿制度中的不确定性,一个相对比较成熟和完善的国际海上救助激励机制正在逐步形成.

| Abstract: | The 1989 Salvage Convention confirmed the outset of marine special compensation regime,however,unsureness and illegibility of special compensation regime of under Article 14 of the 1989 salvage convention encounters huge difficulty in practice.Appearance of SCOPIC clause makes this condition above occur ultimate change,a relatively matured and completed encouraging mechanism of international maritime salvage is forming step by step. |
