| 摘 要： | 现行对征收制度弊端的研究多集中于公共利益问题的探讨,而忽视了这一规则生成的背景分析。如果从政治和经济交互作用的关系视角,通过对公共权力所有权与行使权的分离,可以看出征收制度背后的权力资本化是产生这一问题的原因。

| Abstract: | The studies for the drawbacks of the existing expropriation system are often focused on public interest without considering the analysis on generation background of the rules.From the perspective of interaction of politics and economy,through the separation of ownership and executing right,we can see that the capitalization of power behind the expropriation system is the cause of this problem. |
