| 摘 要： | 共同过失犯罪是否成立，尚存争议。然而，如果结合主客观相一致的原则，那么共同过失正犯、过失教唆犯等共同过失行为有其成立的依据，符合共同犯罪的主客观构成要件；对共同过失犯罪的行为人应按照他们各自的主观罪过来认定他们的刑事责任。

On the Establishment Scope of Joint Negligence Crime and the Criminal Liability |

| Abstract: | It still remains disputable whether the joint negligence crime exists. However, under the principle of unification of subjectivity and objectivity, there lie the grounds of the establishment of principal offender of joint negligence crime, instigator of joint negligence offender, etc, which conforms to the subjective and objective constitutive elements joint negligence crime. The criminal liability of the offender of joint negligence should be assigned in accordance with their subjective crimes. |
