事实劳动关系问题探析

摘    要:与劳动法律关系相伴相生的事实劳动关系问题由来已久。相关劳动法律制度在不断完善的过程中,力图解决因此带来的不必要的劳动纠纷。在最新的劳动合同法中,国家之手用更深入的介入干预劳动关系明显体现了消灭事实劳动关系的立法目的。但我们的法律从未对事实劳动关系的概念、范围等问题作过界定,无论是保护还是消灭都带来操作上的难题。厘清一些基本问题,有利于更好地把握事实劳动关系的法律调整。

Abstract:The factual labor relations go with the labor relations for a long time. With incessant efforts to perfect the related regulations, people try to solve the labor disputes. The latest Labor Contract Act obviously embodies the government's legislative intent to put an end to the factual labor relations through intervention in the labor relations. But the legislation has never stipulated the notion, the scope and other factors of factual labor relations, which eanses many problems in the process of protection and abolishment. And the settlement of those basic issues helps regulate the factual labor relations.
