专利申请中遗传资源来源公开问题系列研究(三)——总体评析、要素分析和相关建议

本文对遗传资源来源公开要求的目的、设立基础和效果、影响等进行了总体评析,指出发展中国家提出这一建议除了旨在加强对遗传资源的保护之外,也体现出对国际知识产权规则加以变革的想法,也正因为如此,发达国家和发展中国家在此建议的作用和效果问题上形成了不同的见解和主张.之后,本文从制度设立的角度对遗传资源来源公开要求中涉及的各个要素进行了介绍,归纳整理了利用现有专利法规定的若干解决思路.最后对我国相关问题的总体解决思路和政策制定提出了建议.

Series Analysis on Matter of Source Disclosure of Genetic Resources——General Comments, Basic Element Analysis and Relevant Proposals

As the final part of the serial study, this article gives general comments on the aim, the legal basis and the effect of this proposed disclosure requirement. It is pointed in this part that this proposal also reflects the demand of developing countries to reform the international intellectual property rules. This is one of the reasons why there are divergent opinions on the influence of the proposed requirement. Then this article explains the basic elements of the disclosure requirement, introduces different suggestions under existing patent laws. The final part is the conclusion and suggestion, including the personal opinion concerning Chinese policy making next step.
