| 摘 要： | 从特征、归责原则以及构成要件的角度对大规模侵权进行了分析。认为大规模侵权是一种新型的侵权行为,在很多方面和传统的侵权行为不同,对传统的侵权行为进行规制的法律并不能完全且很好地适用于大规模侵权,应该有自己独立的一种规制。

| Abstract: | The mass tort is a new kind of tort, it is different from the traditional tort m many ways, and the law about traditional tort can not suit to the mass tort, so there should be a independent rule for the mass tort itself. A preliminary analysis is made for tort from its features, principle of liability and component. The mass tort is analyzed from the aspects of characteristics, principle of liability and elements. |
