| 摘 要： | 针对近年来民法学界对动产转质制度的争论,在一定程度上运用法律经济学和法律社会学的分析方法,对动产转质制度的引入和发展进行了论述,肯定了现行"司法解释"的合理性,否定了"全盘引入"的观点,并对该制度的未来发展提出了建议.

| Abstract: | The main concern of this article is focusing on the rationality of introducing and developing Re-pledge of Movables. With the new approaches of economic and social analysis in law, a conclusion is drawn from my reasoning that a restrained Re-Pledge of Movables should be introduced while the idea of entire introduction should be abandoned. Thereafter, a legislative advice is proposed. |
