| 摘 要： | 本文对检察机关逮捕决定权的正当性提出非难、拮问，在指出其非诉讼化的基础上，勾勒出逮捕自行决定权的异议制度，在赋予被逮捕人救济权的同时，通过上级检察机关监督或同级法院司法审查对检查机关自侦案件逮捕予以节制，体现程序的正当性。
