关于完善我国人民陪审制度的思考

人民陪审制度在我国理论界和实务界一直是一个争议颇多的制度,全国人大常务委员会通过的《关于完善人民陪审员制度的决定》及其《意见>,肯定了这一制度在我国的法律地位。作为推进司法民主与公正的举措之一,人民陪审制度的改革取得了重要进展,但是由于制度的设计不尽科学合理,使得原有的一些问题未能得到解决,在实际运行过程中又出现了一些新的问题。因此,应继续推进改革,避免其形式主义化,以实现陪审制度的积极功能。

Some Comments on the Improvement of the People's Jury System in China

There are always controversies towards the People's Jury System among legal professional and legal scholars.Decision on the Improvement of People's Jury System promulgated by Standing Committee of National People' s Congress(NPC)and the Opinion then approved by the same body established the legal validity and status of this system.As a measure to promote judicial democracy and fairness,People's Jury System has attained remarkable achievements in China.However,there are some drawbacks in the course of procedure-designing,which makes it unable to resolve some existing problems on the one hand,and bring about some new problems.Thus,this system is open to further reform with the aim to make this system really well done.
