| 摘 要： | 宪政的实质就是限政。事实上,把先秦“德治”归入“人治”的范畴是一大历史冤案。通过对先秦德治理念的考察,可以得出两点结论：一,德治旨在限政,在先秦社会表现为限“王”;二,“君权神授”、“以德配天”、“德在民中”实现了民制约王的可能。在现代社会中,“以德治国”不仅不能少,而且还是民主宪政国家建设的必要内容。

| Abstract: | The essence of constitutional governance is limited governance. In fact, it＇s a historical wrong case that ＂the role of Pre-Qin Virtue＂ is brought into ＂the role of man＂. By analyzing the concept of the role of Pre-Qin Virtue, we can draw the following conclusions： Firstly, the rule of Pre-Qin Virtue means to limit Kings＇ rights; Secondly, the conceptions of ＂the divine right of kings＂, ＂virtue obeys the way of heaven＂ and ＂virtue originates from common people＂ make it possible for common people to limit King＇s rights. Thus demonstrating ＂ethics＂ is not only a must, but also necessary for the building of democratic constitutional state elements in modem society. |
