附带搜索的要件和范围——以我国台湾地区法为参考

搜索作为一种强制处分,极易侵害被搜索人的基本权利,如隐私权、财产权以及人身自由权等。附带搜索是一种无令状搜索,更易侵害人民的基本权利。我国大陆对附带搜索的理论研究几乎是空白,台湾地区对附带搜索的研究相对较多。所以研究台湾地区关于附带搜索要件和范围的理论研究成果,可以为大陆附带搜索制度的构建提供帮助。
