人身保险告知义务的履行研究

从人身保险告知义务的法律规定入手,对告知义务履行的时间、内容、方式、免除等进行分析,从而进一步探讨对人身保险合同的影响。在分析过程中,参考了国内学者的有关观点、见解,借鉴了英美等保险立法比较发达国家的立法经验,结合我国保险事业的发展,提出应当采用因果关系说的处理方式,处置投保人未履行如实告知义务的行为。

Performing study of informing obligation of life insurance

From the laws and regulations of informing obligation of life insurance,the performing time,content,method and remission of informing obligation were analyzed,and its influence on life insurance contracts was further discussed.In the analysis process of referencing to the viewpoint and idea of domestic scholars,using the legislation experience in quite developed countries such as the U.S.and the U.K. for reference,combining the development of insurance career in our country,the treatment style of adopting causality theory was proposed to handle the conducts of failing to perform informing obligation by the policy holder.
