| 摘 要： | 通过对计算机软件实施著作权保护中所出现的对软件开发者的认定。软件模块的法律保护，反向工程问题。版权侵权认定等一些难以解决问题的分析，揭示了计算机软件与著作权法所保护的客体两者之间在性质上存在不可调和的矛盾。建议我国学者从软件自身性质出发制定一部能切实保护软件开发者和使用者的特别法对其进行保护。
