矿山安全监管的公法思考

矿难是中国当前备受关注的社会问题.体制变动中的矿山安全监督管理体制虽然对事故多发起到了一定遏制作用,但在监管理念、行政组织和行为方式等方面仍存在主体意识不明、体制不畅、手段僵化等弊病,应从根本上实现由"管理"向"监管"的转变,在矿山领域确立相对独立的社会性安全管制模式.

Public Law Analysis of Mining Safety Regulation

Mining accident has been one of the most obvious social problems at present in China. The changing mining safety regulation system has effectively prevented the accidents, but still has problems such as unconscious regulation motive, rigid measures and other problems in the governmental safety notion, administrative organ and administrative action. So the governance model should be changed from administration to regulation, meanwhile a set of relatively independent mining safety regulation should be established as far as possible.
