中国私家侦探业的发展与多元化私权保障机制的建立

中国的私家侦探业是个舶来品,由于存在巨大的市场需求,因此20世纪90年代后获得了迅速发展。私家侦探的产生对于推动我国多元化私权救济保障机制的建立和发展,切实维护公民的私权利具有重大意义。但是,目前这一行业仍处于尴尬的＂灰色地带＂,缺乏明确的法律定位,缺乏行业管理和有效规范。为此,我们应借鉴有关国家的做法,对私家侦探业进行规划和调整,引导其合法发展。首先,确立私家侦探的合法地位,给其一个名分;其次,建立多元化公民权利保障机制;第三,确定私家侦探的准入资格。总之,要将私家侦探业纳入法制化轨道,促进其健康发展,真正维护公民权益和法律正义。

Private Detectives in China and Alternative Protection of the Private Rights

The concept and the property of private detectives are introduced in the paper in detail,according to the situation of China,in order to learn why private detectives generate and develop so quickly in our country.Combining with the main business scope of Chinese private detectives,the paper sums up the ways they use in the real life to investigative and obtain evidences.It also deals with the great significance of the generation of private detectives in propelling the development of the Chinese alternative protection of the private rights and asserting civil rights.Finally it explores the development direction of private detectives,i.e.by means of programming and adjusting to lead the private detectives industry to a legal development and to fight for asserting civil rights and legal justice.
