| 摘 要： | 我国矿山安全行刑衔接不到位,深层次原因是未引入矿山安全刑事诉权。借鉴广义诉权理论和国外矿山安全立法经验,笔者建议修订《矿山安全法》等相关法律,有条件赋予矿山安全监察员刑事诉权。现阶段,可考虑出台加强矿山安全生产行刑衔接的实体和程序规范。

| Abstract: | The key of interaction of administrative law enforcement with criminal justice is establishing the right of criminal action for mine safety~ Through legal analysis and observation of the right of criminal action abroad, the author proposes to amend the Mine Safety Act, and conditionally given inspectors the right of criminal action for mine safety~ Currently, the Government may consider the enactment of substantive and procedural rules on interaction of administrative law enforcement with criminal justice. |
