| 摘 要： | 经济法的基本范畴包括经济自由权、经济平等权、国家干预权等等.自由竞争是市场经济的基本特征,作为经济法的基本范畴之一的经济自由权即自由竞争权,必须具有保护市场经济自由竞争的作用,必须具有确切的确立标准,必须与经济法的基本原则一致,必须存在与实际的经济法律制度中.因此,自由竞争权作为经济法的基本范畴之一,必须与经济法的理论与实际双方面契合.
