法律强制与道德冷漠之间隙论

法律道德主义者把“法律强制执行道德”视为“法律对不义行为的镇压”,认为法律强制本身具有正当性.而自由主义者认为法律与道德有明显的界限,法律不得对任何无害于他人的行为进行干涉,力图捍卫私人的道德自由.然而,法律道德主义的论断从理论预设到论证过程都不够周全并且可能掉入“道德民粹主义”的漩涡;而后者未将不道德行为进行区分而一味否定强制,则有鼓吹“道德冷漠”之嫌.事实上,法律强制与道德冷漠并不是非此即彼的,二者之间存有间隙.

The Space between the Law Coercion and Moral Indifference

Legal moralist argues that the enforcement of moral is of legitimacy, as the persecution against vice. But the liberalist considers that the law shall not interfere. Individual behavior which is not harmful to any others. However, these two points of view are necessarily imprecise. The view of legal moralist is linked to moral populism and the view of liberalist seems to preach the moral indifference. Actually, there is a space between the law coercion and moral indifference.
