业主自治中参与路径的法学分析

业主参与是业主自治的关键。我国业主参与的不足,严重地制约了业主自治的发展。业主参与不足既有业主参与预期偏低、自治精神淡薄等主观原因,也有制度设计缺陷、参与能力不足、参与成本过高、开发商和政府相关部门的阻力等客观原因。提升业主的参与程度,必须立法消除制度障碍,明确业主在整个物业管理中的主体和主导地位,尽可能降低参与的成本,加强对业主的动员和培训力度,提升小区文化建设,营造业主参与的良好氛围,明确各相关单位的责任,减少参与阻力。

Owner participation is the key to owner autonomous.Our country owner participation’s insufficiency,has been severely restricting the development of owner autonomous.The insufficient participation has subjective reasons of owners involving in anticipating and autonomy spirit on the low side,also has objective reasons of the system design flaws,participation ability inadequacy,participation cost exorbitant,and the resistance of developers and government departments related to.To enhance owners’ participating in degree,must act to remove system obstacle,clear owner in the property management in the main body and dominant position,as far as possible to reduce the cost of participation,strengthen to the owners of the mobilization and training,enhance construction of community culture,build owners ’ participating good atmosphere,clear all relevant units of the responsibility for reducing involved in the resistance.
