西学东渐与中国近代版权制度的建立

版权是随着印刷术的发明及广泛使用才可能产生。印刷术大大提高了作品的复制与传播效率。版权观念在中国产生较早,但是中国版权的立法保护,却落在西方人的后面。随着＂西学东渐＂的不断深入,以及一些有识之士的宣传和躬身实践,晚清政府才制定和颁布了中国历史上第一部版权法律《大清著作权律》,改变了中国版权发展历史的分期,中国版权保护历史从分散的、不完整的地方官署的告示保护发展到具有全国意义的保护,中国版权保护开始从人治逐步向法治过渡。

The Entrance of Western Culture and the Establishment of Modern Chinese Copyright System

Only when typograhy was invented and widely used did copyright come into being.The use of typograph had tremendously improved the efficiency of copying and transmissing works.The conception of typograhy appeared early in China,but we fell far behind the Westerners in legislating on proctecting copyright.In the Qing Dynasty,with the entrance of the western culture,intellectuals constantly advocated innovation,under the pressure of which Qing government had to promulgate the first copyright law of China： Copyright Law of the Qing Dynasty.From then on,the development of chinese copyright changed,making copyright protection form local protection to national one,from being governed by man to being governed by laws.
