| 摘 要： | 我国经济发展仍处于从弱至强的过程中,打击侵犯商业秘密行为应持慎重的态度,要保护好商业秘密权利人与竞争者的合法利益。在惩罚商业秘密犯罪行为时,要充分运用刑法谦抑性原理,注重处理好倡导信息自由与自由竞争、激励创新与尊重创造、维护商业诚信与保护劳动者合法权益三对关系,防止商业秘密刑事处罚演化为一种过分之刑、昂贵之刑、滥用之刑或无效之刑。

| Abstract: | The China’s economic development is still in the process from weak to strong,the fight against the infringement of commercial secrets acts should adopt a cautious attitude,both to protect the interests of right holders of trade secrets and competitor.When we punish the trade secrets crime,it is necessary to make full use of the Modesty principle of criminal law,to advocate freedom of information and freedom of competition inspire innovation and respect for creation.At last we must prevent trade secrets criminal punishment evolved into an excessive criminal,an expensive of torture or invalid sentence. |
