我国劳动争议处理机制之程序保障的应然价值取向

摘    要:20世纪自90年代以来,程序保障的理论在诉讼程序上得到了极大的重视。为了构建和完善我国现行的劳动争议处理机制,笔者认为程序保障理论应渗透到劳动争议处理机制的各程序机制中。因此,本文提出了我国劳动争议处理机制之程序保障的三大应然价值取向,即程序公正、程序效益和程序安定,以及它们各自在劳动争议处理程序机制中的应然体现。

Abstract:Since the90s of the20 th century,the theory of procedural protection has been paid much attention to in the lawsuit procedure.In order to set up and perfect the present system of labor dispute solution of our country,the author suggests that the theory of procedural protection should be applied in each procedure of the labor dispute solution.So this essay puts forward the three value standards to protect the procedures in the system of our labor dispute solution:procedural justice,procedural efficiency and procedural security,and their application in the system of labor dispute solution.
