| 摘 要： | 组织卖淫罪有关问题的研讨一直是刑事法界和司法实务界关注的热点之一,特别是＂强迫＂是否应成为组织卖淫行为的手段＂、他人＂是否包括男子、多名组织卖淫者之间是否有主从犯之分及其死刑的存废问题一直是学术争论的焦点。不论是从学术上还是司法实务上研讨,对该罪进行更深层次的探究具有较高的价值。因而以司法实务为切入点,主要从组织卖淫罪的特殊理论和组织卖淫罪修正的构成两个问题加以探究。

| Abstract: | The organizational prostitution crime has always been a heated issue in the circles of criminal law and judicial practice.And questions of "by force" as the means of organizational prostitution,male being included in "others",the discrimination of principal and subordinate criminals among several criminals and death penalty abrogation are the focus of academic debates.Either from academic perspective or judicial practice,a deeper exploration of the crime has a high value.The paper,starting from judicial practice,investigates the special theory of organizational prostitution crime and the composition of the amendments of organizational prostitution crime. |
