加入WTO与建立健全我国反垄断法制

1999年底 ,我国与美国就加入世贸组织达成协议 ,2 0 0 0年 5月我国又与欧盟就中国加入世贸组织达成协议。这两个双边协议使我国入世谈判取得了重大突破 ,使我国入世步伐大大加快。据有关人士分析 ,今年内我国有可能正式加入WTO。“入世”之后的中国市场将逐步成为开放、竞争、平等、透明的市场 ,将会有更多的国内外竞争者在中国市场上进行公平、平等的角逐。在市场竞争中 ,参与竞争者适用相同的竞争规则 ,而且用以规范竞争的规则也逐步走向国际通行的规则 ,这是市场有效运行的基础性条件。所以 ,从法律角度而言 ,我国加入WTO后最大的挑战是如何建立健全比较完善的法律制度 ,对一些不符合世贸组织规则的法律、法规、规章和政策要进行适时的修订和完善。本文试就建立、健全我国反垄断法制问题谈点认识和看法。为了适应入世后的挑战 ,我国需要在反垄断法方面及早着手准备 ,以免陷于被动。

JOINING WTO AND IMPROVING ANTI-MONOPOLY LAW

China has achieved agreement with U.S.A. and EEC about joining WTO recently. The bilateral agreements signed China has made break-through, and speeded up the the negotiation of entry into the WTO. According to analysis of interrelated personage China may join WTO formally in the year. The opening, competing, equal and transparent market will be formed step by step. In the equal competition the competitors will play in the same rules. The rules will be nationalized step by step. This is the base of efficiently operating for the market. From points of law, the great challenge to China is how to make up a perfect legal system. China must prfect and amend the law and regulations after joining WTO. The authors try to give opinions about how to set up and perfect anti-monopoly. China must prepare for the challenge as soon as possible to avoid passives.
