| 摘 要： | 目前,我国没有对法官的法律解释进行有效规范的机制,由于成文法的不足,实践中常常导致法官判决的不统一。判例法制度下,法官的法律解释受判例"遵循先例"原则和"裁判自律"原则的约束是以达到同案同判的预期;其司法权威保障了法官通过法律解释形成判决的法律效力。判例的专业性程度及效力在两大法系对法官法律解释产生的不同作用,凸显了判例法国家对法官法律解释的有效规范。我国虽不能实施判例法制度,但可以借鉴。
