公私合作(PPP)合同存在的问题与解决对策研究

公私合作(PPP)合同作用重要但存在的问题日益突出,因此从PPP合同设计和履行两个阶段综述合同存在的问题,并提出解决对策。设计阶段存在问题有:风险分配不合理;合同不完整;合同法律性质不明,履行阶段存在问题有:法律法规保障不足;政府契约精神薄弱;监督体系不完善;重新谈判问题。针对问题提出相应解决对策有:建立合理的风险分担机制;完善法律框架;规范政府行为;建立有效的监督框架;增加灵活性合同,建立常规性再谈判机制。

Research on Problems and Solutions of PPP Contracts

The role of PPP contract is important but the existing problems are increasingly prominent. Therefore, the problems existing in the contract are reviewed from the two stages of PPP contract design and implementation, and solutions are proposed. There are problems in the design stage: unreasonable risk distribution; incomplete contract; unclear legal nature of the contract; problems in the performance stage: insufficient legal and legal protection; weak government contract; imperfect supervision system; renegotiation. The corresponding solutions to the problem are: establishing a reasonable risk sharing mechanism; improving the legal framework; standardizing government behavior; establishing an effective supervision framework; increasing flexibility contracts and establishing a regular renegotiation mechanism.
