| 摘 要： | 中国古代法律渊源中判例法是一个非常复杂的问题,因为中国古代与判例法有关的概念很多,且各概念之间有不同含义,同一概念不同时期含义也不相同。中国古代与判例有关的概念有秦朝廷行事、汉朝决事比、晋朝的故事、唐朝的法例、宋元两朝的断例、明朝的事例、清朝的通行等。此外还有案例、判牍、例与判例等不同概念。对不同概念含义进行分析,能让学界认清中国古代判例法的相关特征,有利于学界正确认识我国古代法律的特征及运作机制。

| Abstract: | It is a very complex issue that the sources of law in ancient Chinese case law because the concepts with a lot of case law in ancient Chinese,and the concepts have different meanings and the meaning of the same concept at different times is not the same.There are different names in different dynasties,for example,the judicial case in Qin Dynasty;the Precedent work in the Han Dynasty,etc.The meaning of different concepts for analysis,allowing the scholars to recognize that the relevant features of the case law are conducive to a correct understanding of the academic characteristics of China＇s ancient legal and operational mechanisms. |
