选择正义：关于战争性质的评价

当代,对战争性质的评价主要有两种标准,一种是有关的国际法准则,一种是西方的“正义战争论”。这两种评价标准都有局限,应在利益,道德、法理三项原则相结合的基础上构建一种新的评价模式,对战争的原因,目的,方式和后果四个方面进行具体分析,从而全面合理地认识战争的性质。

Choose Justice: About Evaluation of War

In modern time, there mainly exist two standards of the evaluation of war. One of them is the principle of international law, and another is the "Just war theory". In this article I would analyze these two standards of the evaluation of war and give some suggestions on how to construct a new standard of evaluating war. I would argue that the new standard is based on the combination of three principles interest, ethic and jurisprudence. Moreover, I would argue that the new standard also is on the basis of analyzing the cause of war, the purpose of war, and the mode of war, and the aftereffect of war. With the new standard, I think we could evaluate war comprehensively and rationally.
