| 摘 要： | 贸易与环境问题是一个涉及国际社会多层面、多领域的复杂而重大的问题，已成为WTO新一轮多哈回谈判的重要议题。GATT1994第20条环保例外条款，承认了各国国内环境政策的合法性，但运用不当则容易演变成贸易保护手段，从而阻碍国际贸易的发展。国际社会尤其是发展中国家对此应有足够的认识。

| Abstract: | The problem of trade and environment is a complicated and important problem concerning many levels and fields of international society, which has become an important issue to be discussed in a new round of negotiation of WTO. The 20th exceptional term on environment protection in GATT(1994) recognizes the legitimacy of the domestic policy on environment of every member country, but its inappropriate application might become a protective measure of foreign trade so as to hinder the development of international trade. International society, especially the developing countries should have a good knowledge of it. |
