| 摘 要： | 论证评价中争议最多的因素就是论据能否为论题提供充分的支持,法律论证评价也不例外。法律论证评价的核心问题就是法律论据的评价标准。在这一评价过程中所体现的精神与批判性思维的精神具有内在一致性。

| Abstract: | Whether argument can provide sufficient support for the topic is the most controversial factor in argumentation evaluation,and there is no exception in legal argumentation.So the key problem of legal argumentation evaluation is legal argument’s evaluation standard.There is inherent consistency between the spirit embodied in the evaluation and the criticism spirit. |
