| 摘 要： | 耕地承包期限的刚性规定稳定了农地承包关系,受到了农民的赞同。然而,该规定及其配套政策却违背了农民＂均田地＂的公平理念及农村社会的＂生存伦理＂,致使其在实践中未得到严格的实施。权衡各方面的制约因素,耕地承包应实行弹性期限的制度规定,在弹性期限内＂大稳定、小调整＂,以增强其亲和力。

| Abstract: | The rigid provisions of contract period of arable land stabilize contract relations of the agricultur- al land, and also are endorsed by farmers. However, those provisions as well as their supporting policies have not been strictly implemented in practice because they disobey farmers＇ fair concept of ＂equal division of land＂ and ＂survival ethics＂ in the rural society . Weighing various restrictive factors, a system of flexible period of land con- tract should be implemented in order to enhance its affinity, and the system should be kept stable in bulk and just could be made appropriate adjustments. |
