有关走私犯罪争议的几个问题探析

当前关于走私犯罪争议颇多，如走私罪侵犯客体之争、走私犯罪罪名之争、武装掩护走私与暴力、威胁抗拒缉私行为的区别之争等。应当指出，首先，走私犯罪侵犯的客体是国家正常的对外贸易秩序；其次，罪名的确定，可从罪名划分的科学性和罪名名称的科学性两个角度进行分析；最后，武装掩护走私的，应当作为各具体走私犯罪的从重处罚情节。

Exploration into the several problems concerning smuggling crime

At present there are many disputes over smuggling crime, such as infringement object of smuggling crime, the name of smuggling crime, distinction between smuggling by armed protection and resistance to seize smuggled goods by violence or threat. It should be pointed out that： firstly the infringement object of smuggling crime is the regular national foreign trade order; secondly, the definition of crime may be analysed from the science of classification of crime and the science of naming crime ; lastly, smuggling by armed protection should be considered as plot of severe punishment of each smuggling crime.
