司法解释与立法的“脱耦”与“耦合”——评《关于涉外民商事案件诉讼管辖若干问题的规定》

对涉外民商事案件进行集中管辖,是我国司法改革又一重要举措。但最高人民法院《关于涉外民商事案件诉讼管辖若干问题的规定》存在三方面问题:将造成基层法院处理涉外案件法官断层的严重后果;具体内容含混、矛盾,与相关规定冲突;有以下犯上、篡越法律的嫌疑。
