| 摘 要： | 首先介绍了平行进口的基本概念、特点和各种理论学说(主要包括地域性理论、权利穷竭理论、默示许可理论等),然后比较了各国对平行进口问题的相关立法情况,最后从知识产权保护制度根本目的、世界各国立法趋势、国际贸易发展要求、以及我国当前国情四个角度出发提出了对我国立法的一些启示———应该允许而不是禁止平行进口。

| Abstract: | Basic concept、characteristics、and kinds of theories of parallel imports(such as principle of territory、exhaustion of rights doctrine and implied license theory)were firstly introduced in the paper,then we compared the laws on parallel imports in different countries,and lastly we made clear that we should permit not just prohibit parallel imports from several ways,which are final objectives of IPR protection、global trend of legislation、requirement of international trade and the situation of China. |
