| 摘 要： | 典权作为中国固有的一项物权制度,在我国已延续上千年,可谓渊源流长。但学者对典权的一些基本问题,尤其是典权的性质仍存在较大争议,在《物权法》颁布后的今天,人们对典权在物权法中是否应该加以规定,分歧颇大,笔者拟在本文中谈谈自己的看法。

| Abstract: | The pawning right,one of real right system of China,has a long history of thousands of years.But scholars have many disputes on quite a few basic problems,especially on nature of pawning right.Nowadays,people still find it difficult to reach an agreement on whether to ordain it after the promulgation of Property Law.The author gives some opinions. |
