| 摘 要： | 对上下班途中发生的交通事故、职工"过劳死",以及由于工作压力过大造成的精神损害是否一律认定为工伤问题进行了探讨。提出,是否认定为工伤不仅要依据相关的法律规定,更要有一个统一的工伤认定原则,即事故的发生是否"与工作有关",凡是"与工作有关"就应当认定为工伤,反之,则应以非工伤处理。

| Abstract: | This paper concentrates on whether the issues,such as traffic accident while working,death from overwork and mental illeness from work stress,are identified as work-related injuries.It is proposed that work-related injuries should be identified not only based on the relevant legal provisions,but also a unified principle that the injuries are work-related.Those resulting from work should be recognized as work-related.Otherwise they should be to non-work-related injuries. |
