| 摘 要： | 区别于非法占有目的的传统研究,另立视角,就非法占有目的产生时间的涵义、理论价值、实践意义及其认定等问题作了研讨。非法占有目的的产生时间问题,是深入研究非法占有目的、合理解决定罪量刑需要提出并加以系统研究的新课题,应引起重视。

| Abstract: | This article explores the definition, theoretical value, practical value and the judgment of the formation of illegal possession in criminal law from the special angle which is quite different from the traditional research. The author states that the formation time of illegal possession, to which great importance needs to be attached, is the new research question in relation to the study on the purpose of illegal possession and reasonable conviction and penalty. |
