| 摘 要： | 2012年3月14日,第十一届人国人民代表大会第五次会议审议通过了《关于修改<中华人民共和国刑事诉讼法>的决定》,对我国刑事诉讼法作了重大的修改,以我国的刑事诉讼体系进行了进一步的改良,非法证据排除制度在这次修改中的得到了进一步的确立和完善,准确理解新修改的刑事诉讼法中关于非法证据的内涵、外延、绝对排除与相对排除、启动程序、应对措施,对反贪工作具有重要而深远的意义。

| Abstract: | On March 14th in 2012, the fifth meeting of the 11th National People’s Congress examined and approved ＂On the decision of the amendment to the Criminal Procedure Law of the People’s Republic of China＂. The amendment made great revision and improvement to the criminal procedure law of our country. The system of excluded illegal evidence was established and improved. It is important and significant for anti-corruption work to precisely comprehend the connotation and denotation of illegal evidence, absolute exclusion and relative exclusion, opening procedure and counter-measure in the amendment. |
