| 摘 要： | 对民商合一模式、民商分立模式、复合模式以及制定《商事通则》模式等四种商法系统化的理论模式进行了实证分析，提出了解决这个问题的对策：即通过制定商事通则的模式来实现我国商法的系统化或体系化。

| Abstract: | Empirical analysis on four theoretic patterns of systematism of commercial law is carried on, which are： the syncretism of civil and commercial law; the separation of civil and commercial law; the compound mode; the mode of General Principles of Commercial Law. The solution to this problem is put forward, namely, the systematization of the commercial law of China could be realized through the legislation of General Principles of Commercial Law. |
