| 摘 要： | 介绍了我国夫妻共同债务制度的现状。总结了我国现行夫妻共同债务制度的主要问题:夫妻共同债务范围认定的问题,在保护夫妻合法权益的同时应保护第三人的合法权益,对夫妻共同债务的规定应更条理化、系统化。提出了完善夫妻共同债务制度的对策:增设夫妻日常家事代理权制度,建立财产补偿制度,建立债务夫妻共同签字制度,设立约定公示和夫妻财产登记制度。
