| 摘 要： | 司法信任问题从古至今都是非常棘手的问题.在我国历史上,司法不信任的表现主要体现在民众对司法裁判结果、司法裁判人员以及司法裁判效力的普遍怀疑上.而造成司法不信任的原因主要有两个方面,一方面是司法活动的本体根源,即司法活动的稀缺性、专业性以及对决性;另一方面是历史原因,包括君主专制的政治考量、司法裁判专业能力不足、文化传承的负面记忆等因素.

| Abstract: | Judicial trust has been a tough problem since ancient time. In the history of China, judicial distrust mainly expresses itself in the public distrust of file result of judicial adjudication, the personnel of judicial adjudication, and the effect of judicial adjudica- tion. There are two major reasons for judicial distrust： the first is an ontological reason, i.e., scarcity, specialization and confronta- tion of judicial activity; the second is a historical mason, including the political consideration of autocratic monarchy, the professional incompetence of judicial adjudications the negative memory of cultural inheritance, and etc. |
