受贿罪本质视野下的利益要件检视

以受贿罪的本质检视我国受贿罪中"为他人谋取利益"的规定,可以发现这一要件在受贿罪中发挥着不可或缺的作用。然而利益要件所担当的重要功能,不仅使刑法理论对这一要件的解读陷入了困境,也造成了司法适用的混乱。通过对比国外的立法经验,我国应弱化利益要件的功能,使其逐渐淡出刑法规范;丰富职务要件的内涵,使其承担起受贿罪的理论使命。

Inspecting Interest Elements with the Vision of Bribes

Inspecting the regulation of ＂securing benefit for others ＂ with its nature of accepting bribes, it can be found this element plays an indispensable role in acceptance of bribes. However, the important functions the interest dements carries out put not only the interpretation on the elements into dilemma by the Theory of Criminal Law, but also the judicial application into confusion. By comparing foreign experience of legislation, our country should weaken the functions of interest elements to render it obsolete and enrich the content of duty elements to shoulder responsibility for explaining the theory of taking bribes.
