| 摘 要： | 心理学法学是以心理现象来解释法律特征的总称，它对法学的推进是功不可没的，法律现实主义得以诞生大多是由于法学中使用了心理学的研究方法。尽管如此，但心理学法学并没有因为自身对法学推进的功绩而获得相应的名声，甚至在法学发展的潮流中有着湮没的迹象。经过对这一议题的历史考察，可以发现，这并非法学不再需要进行心理现象的解释了，而是这一研究取向已既成范式且融人到其他法学流派之中了。

| Abstract: | Psychological legal science is not an individual legal school.It is a general summarization that is used to interpret legal features from the aspect of psychological phenomenon.And it usually belongs to sociological legal science or realistic legal science in modern Western legal theoretical schools.However,the promotion of psychology to legal science cannot be neglected.The birth of legal realism owes much to the psychological research methods which are applied into legal science.Using psychological methods to study legal issues has become a part of legal research.Then,we have taken adjusting regulation of human behavior as the research subject in legal science and cannot neglect human's own psychological activity. |
