| 摘 要： | 逮捕告知规则是一项重要的人权保障机制。但是由于我国长期以来重实体、轻程序的观念影响,我国刑事诉讼法对逮捕告知规则的规定不太完善,不利于保护被追诉人的权利。参考域外法治国家对逮捕告知规则的规定,应从告知的主体及对象、告知的时间、告知的方式、告知的内容、逮捕证记载的内容、违反逮捕告知规则的法律后果几个方面对我国逮捕告知规则予以修改和完善。

| Abstract: | The rule for notice of arrest is an important mechanism of human rights security. But in our country, because of the neglect of procedure, the rule for notice of arrest in the criminal procedure isnt perfect, which is not favourable for the protection of the right of the prosecuted. By reference of the rule for notice of arrest in the foreign countries governed by law, the author holds the view that we should revise and perfect the rule for notice of arrest in our country. |
