论法治与德治的关系

分析了法治与德治的关系,指出法治和德治作为治国方略中的二个子系统,法治是治国的基本方略,德治能够有效降低法治的成本,二者优势互补,具有密切的关系。认为我们在建设社会主义法治时要注意对公民进行道德教育,妥善谨慎地处理道德法律化问题,使法律的正义、秩序、人权等价值得到彰显。

Relationship Between Rule of Law and Rule of Virtue

The relationship between rule of law and rule of virtue is introduced.It is pointed out that,rule of law and rule of virtue are both complementary subsystems of the state-governing strategies,rule of law is the basic state-governing strategy,rule of virtue can reduce the cost of the rule of law effectively,and they are very close to each other.It is considered that,when constructing law of socialism,people must put attention to the people's moral education,and carefully deal with the problems of moral legalization so as to demonstrate justice, order,human rights and other values of the law.
