| 摘 要： | 在哈贝马斯对正义进行探讨的过程中,法律有着举足轻重的作用：法律是正义的建制向度。正义由良好秩序来体现,秩序的产生要求建制,法律内含的事实性和有效性的张力使其成为建制的首选途径。

| Abstract: | In the discussion of justice, Habermas sings high praise for the law＇s Junction ： law is the structure direction of justice. Justice embodies in the well-order, well-order produced by the structure direction, the feature of the tension between facility and validity of law maizes it be the first approach to the structure direction for well-order. |
