| 摘 要： | 我国产品责任法应以保护处于弱地位的消费权益为出发点，对产品定义作出扩大解释；损害赔偿范围可借鉴英美法系的惩罚性损害赔偿制度；责任主体的范围也应突破原先只有生产和销售才承担严格责任的规定，并指出在某些特殊情形下，责任主体的具体确定问题。

| Abstract: | To protect the rights and interests of the consumers who are in a disadvantageous position,there should be some revisions in the product liability act.Firstly,the definiton of the product should be further developed.Secondly,the extent of damage compensation should be in the light of the punitive damage compensation of British and American legal system.Thirdly,the extent of liability body should not be limited only to manufacturers and sellers.The act should also offer examples of defining the liability body in certain cases. |
