浅析转化犯

转化犯的概念,应包括罪与罪之间的转化,非罪与罪之间的转化以及罪(非罪)与拟制罪之间的转化.转化犯构成必须具有前行为、后行为以及实施该行为过程中行为人主观上的故意要求,且行为应符合法定的转化条件.在转化犯的分类上,不应将拟制的转化犯脱离转化犯范畴,否则会造成司法实践和转化犯理论上的混乱.判断转化犯的标准应以转化犯的构成要件为主要依据.
