| 摘 要： | 有关国有企业以及一些商业行为能否享受国家及其财产豁免，一直是国际法学界关注的热点。如何在不断发展的国际经济形势下正确理解国家及其财产豁免，如何界定国家行为和商业行为，文章结合《联合国国家及其财产管辖豁免公约》内容对相关问题进行了有益的探讨。
