| 摘 要： | 阐述正确处理违反法定程序的具体行政行为应采取的态度,同时借鉴其他国家或地区的做法,认为违反法定程序的具体行政行为不宜一概撤销:具体行政行为严重违反法定程序的,人民法院应当判决撤销,并可以判令行政机关重新作出具体行政行为;但判决撤销具体行政行为可能对公共利益造成重大损害的除外。

| Abstract: | The paper,by discussing the attitude for correctly handling the specific administrative behaviors of violating legal procedure and by drawing reference from the practices of other countries and regions,holds that not all the specific administrative behaviors of violating legal procedure should be revoked.When specific administrative behaviors seriously violate legal procedure,people's court should give the judgment of revoking them and could also ask the administrative departments to perform new specific administrative behaviors.However,when revoking specific administrative behaviors might do great harm to public interests,they should not be revoked. |
